TERMS OF SERVICE

1. Deposits and Cancellations
All deposits are non-refundable and cover pre-production, scheduling, and admin.
Requests to cancel or postpone must be in writing.

  • Postponing within 3 days of the shoot incurs a 15% fee of total quoted amount

Shake edu is flexible and understands that school environments can shift quickly. If a project needs to be changed within 3 days of the scheduled shoot, Shake edu may waive or adjust the postponement fee at its discretion, depending on circumstances and prior client relationship.

If a project cannot be rescheduled within 14 days of the original shoot, it is considered cancelled.

Force Majeure: Natural disasters, illness, or emergencies may void cancellation fees where applicable. Rescheduling will be subject to availability.

2. Copyright and Usage
Shake edu retains full copyright of all footage and imagery. Clients may use approved content as per the licensed usage outlined in the quote or agreement. Third-party access or broader use must be approved in writing and may incur an additional release fee of 40% of the quoted project value.

3. Client Footage Access
Clients on a package plan have ongoing access to a digital vault of colour-graded selects. Use beyond agreed terms must be negotiated.

4. Raw Footage
Raw or unused footage is owned by Shake edu. Clients may purchase these files at 50% of the total production cost.

5. Use of Footage by Shake edu
Shake edu reserves the right to use footage captured for promotional purposes. Any students without appropriate release consent will not appear. Shake edu will remove content promptly if notified of a breach.

6. Scope Changes
If a client changes the agreed deliverables post-filming:

  • Removing editing: editing portion of deposit is non-refundable

  • Adding editing later: editing will be quoted separately

  • Changing raw delivery or usage may incur cancellation or re-quoting fees

7. On Location
A school representative must be present on-site during filming. If no representative is present, Shake edu’s creative interpretation will be final.

8. Invoicing and Payment

  • Invoices are sent in two stages: one post-shoot, and one on final delivery.

  • Late payments incur a 5% weekly penalty on overdue amounts.

  • Final delivery is withheld until full payment is received.

9. Rural & Interstate Schools
Schools located outside metropolitan Melbourne must agree to structured filming blocks before signing onto a term-based package. This ensures travel time and resource use are balanced fairly.

10. Client Workflows (Packages vs One-Offs)
Clients on a term-based package receive hourly access to filming, editing, and production services. One-off projects follow traditional day-rate billing. All work includes a set number of review rounds; excess revisions may be billed separately.

11. Work Acceptance
Final work is deemed approved 14 days after delivery unless feedback is provided in writing.

  • 12. Trial Video (Free Offer)

  • One complimentary video (up to 90 seconds, 1-person crew) is offered to new schools.

  • Shake edu retains full copyright.

  • No obligation to proceed.

  • Minor feedback accepted; major edits outside the agreed scope may incur charges.
    Trial footage cannot be repurposed beyond the scope of the offer.

13. Disputes & Liability
Any disputes will first go through negotiation, then VCAT mediation if required.
Shake edu’s liability is limited to the total amount paid. No responsibility is taken for indirect or consequential losses.

Agreement Activation
These terms are considered accepted when a quote is approved by the client. Terms appear on every quote, invoice, and email footer.
